On this 2 nd day of April 1818 before me the subscriber one of the Judges of the Court of Common Pleas for the County of Rensselaer personally appeared David Barnheart aged 65 years, resident in the Town of Hoosick in the said County who being by me first duly sworn according to law, doth on his oath make the following declaration in order to obtain the provision made by the late act of Congress entitled “An act to provide for certain persons engaged in the land and naval service of the United States in the revolutionary war” That he the said David Barnheart engaged as a substitute for the term of nine months in the company commanded by Captain Strong, and sometimes by Captain Theodosius Fowler, Capt. Dunscomb & Capt. David in Colonel Harry B. Livingstons Regiments and that he again enlisted for during the war under the above named Colonel in brigade commanded by (he thinks) General James Clinton that they were stationed at West Point in the State of New York and marched from thence to New Jersey, was in Monmouth Battle, and in the expedition under General Sullivan against the Indians and was marched from place to place and was at length stationed at Fort Stanwix in the State of New York and that he was sent with a party of nineteen men to cut wood and were surprised and fired upon by the enemy one man killed and the rest with himself made prisoners, and that he remained a prisoner until the close of the war—and that he is in reduced circumstances and stands in need of the assistance of his Country for support.

Joseph Barnheart being duly sworn says that the above named David Barnheart is his brother that he is knowing that the said David engaged in the service for the term of nine months and that he was informed that he afterwards enlisted for during the war, and that he was absent from Hoosick which was his place of residence at that that time four or five years.

Sworn to and declared before me the day and year aforesaid.

I Joseph Dorr one of the Judges of the Court of Common Pleas for the county aforesaid do certify that it appears to my satisfaction that the David Barnheart did service in the war as stated in the preceding declaration against the common enemy; and I now transmit the proceedings and testimony taken and had before me to the Secretary for the Department of War, pursuant to the directions of the aforementioned act of Congress. This may certify that it is my opinion that David Barnhart is in Reduced Circumstances and that he stands in need of the assistance of his Country for Support. Joseph Dorr.

Schedule of the real and personal Estate necessary Beading & Clothing accepted of Barnhart a pensioner of the United States, has no real Estate—Personal Estate none. I am by occupation a Farmer but am unable to Labour to support my life. I have no family, my pension I gave my son who supports me.

On this 11 th day of May in the year of our Lord One thousand Eight hundred and fifty four Personally appeared before me Nathan T. Burdick a Justice of Sessions in and for said County. Margaret Barnhart a resident of the town of Grafton in said county and State of New York aged Fifty one years and upwards who first being duly sworn according to Law doth on her Oath make the following Declaration in order to obtain the benefits of the Provisions made by an Act of Congress Passed February 3d, 1853. An Act granting half pay and Pensions to certain Widows. That she is the Widow of David Barnhart who was a soldier during the war of the Revolution and late a pensioner of the United States under the Act of Congress Passed March 18 th 1818 at the rate of ninety six dollars per Annum until the day of his death which took place at Grafton June 14 th 1842. She further declares that she was married to the said David Barnhart November 8 th 1829 by Harry Pattison a Justice of the Peace in the town of Hoosic County of Rensselaer and State of New York. That her husband the aforesaid David Barnhart died June 14 th 1842 and that she has remained a Widow ever since that period as will more fully appear by a reference to the proof hereunto annexed.
